The Estonian Patent Office’s trade mark of the month for November is POKTEIL, which has received legal protection for mixed drinks made from dairy products. The owner of the trademark is SA Järvamaa, which created the trade mark with the aim of promoting Järvamaa’s special food product – milk. “Pokteils” are the name given to milkshakes.
Considering that POKTEIL is a distinctive term for the company’s own milkshakes, it was decided to register it as a trade mark. Additionally, they intended to give their trade mark to the dairy industry and small local producers for product development. The trade mark owner urges all business owners to safeguard their original product names since you never know when it may be vital. According to the owner, this is the only way to avoid a scenario in which a deceptive business owner also takes their made-up name and registers it as a trade mark. It takes time from the submission of the application to the decision, but before formalizing it, the owner definitely recommends consulting a trade mark expert – if there are doubts, for example, whether the name can be protected as a trade mark or which goods and services to choose for the application.
