The scope of legal protection of an industrial design is based on the representation of the design presented in the application for registration. Each variant of an industrial design acquires legal protection independently. A set of industrial designs acquires legal protection as a whole.
The rights acquired by registration of an industrial design are territorial. Industrial designs registered in the Estonian Patent Office are protected on the territory of the Republic of Estonia. An owner of a Community design enjoys protection in all member states of the European Union (incl. Estonia). Designs registered in the offices of foreign countries have protection in the relevant countries.
The rights of the owner of the registered industrial design are valid for five years.
The validity can be renewed by paying a fee for a period of five years at a time up to a total term of twenty-five years.
